Terms and Conditions of Use
Last updated: September 28, 2026
These Terms are a standard-form (adhesion) contract. The clauses in bold allow FromChats to suspend, limit or change the service, or limit your rights: read them carefully before accepting.
1. Identification of the provider
This document governs access to and use of the FromChats platform, accessible at https://fromchats.com. The site is operated by Carmelo Jesús Chery Martino, natural person, identified with Cédula de Identidad Personal No. 8-878-783, holding Operating Notice No. 8-878-783-2026-574428213 issued by the Ministry of Commerce and Industry of the Republic of Panama, with registered business address at District of La Chorrera, Panamá Oeste Province, Republic of Panama.
Contact email: soporte@fromchats.com.
2. What FromChats is and what it is not
FromChats is booking management software sold to businesses on a subscription basis. An automated assistant powered by artificial intelligence serves the business's clients on WhatsApp, Instagram and Telegram, and each business also has its own booking page on the web. Through those channels the end client looks up the services and books, reschedules or cancels appointments. The business manages everything from a panel: calendar, clients, services, opening hours and team.
- The business's staff can take over any conversation from the panel inbox and reply themselves.
- If the client asks to speak with a person, the business is notified. From that point on, service is the responsibility of the business, and FromChats does not guarantee its availability or response time.
- Agencies handling paperwork can ask their clients, through the platform, for the documents they need for a procedure (identification, forms).
- Online sessions take place by video call using Jitsi Meet.
FromChats is not a marketplace or a payment intermediary. It does not process, collect, hold or settle payments from end clients to businesses: that function is disabled on the platform. If a business charges its clients, it does so on its own, outside FromChats, and is solely responsible for those charges. FromChats is not the owner, producer or provider of the services booked: each business contracts directly with its end client and is solely responsible for that relationship.
3. Definitions
- Platform: the FromChats website, the businesses' booking pages, the FromChats chat on the messaging channels and the management panel.
- Affiliated business: the natural or legal person that registers its business on the platform and pays the subscription to manage its bookings.
- Assistant: the automated, artificial-intelligence-based system that handles conversations on behalf of the business.
- End client: the person who books an appointment with an affiliated business through the platform.
- Payment processor: dLocal Go, the authorized provider that charges the subscription to the affiliated business.
4. Registration and account
- To use the platform, both the business and the end client create an account, provide truthful and up-to-date information and accept these Terms and the Privacy Policy.
- They are accepted by ticking the box when registering. That electronic acceptance is as binding as a signature, and the platform records its date and the version accepted. These Terms can be viewed and printed on this page at any time.
- The account holder must be over 18 years of age and have the legal capacity to contract. Minors book through their father, mother or guardian, who creates the account and is responsible for its use.
- Access credentials are personal and non-transferable. The holder is responsible for all activity carried out from their account.
- You must notify us immediately of any unauthorized use of your account.
- We may require documentation evidencing the identity of the holder and the legal existence of the business.
5. Obligations of the affiliated business
By affiliating, the business undertakes to:
- Offer only lawful services, and hold the permits, licenses and registrations that its activity requires.
- Publish truthful and complete prices, including applicable taxes.
- Provide the booked service under the conditions offered and inform its clients of its cancellation terms.
- Handle its clients' complaints and, if it charges them anything on its own, resolve any refunds that may apply.
- Review the information the assistant gives on its behalf and keep its services, prices and opening hours up to date.
- Comply with its tax, labor and data-protection obligations.
6. End clients
For the person booking, FromChats is the tool used to request and manage the appointment: a single chat and a directory from which to book with different businesses without registering with each one. The service booked is provided by the business, and the agreement on that service —price, payment method, cancellations, no-shows— is between the client and the business, in accordance with the terms the business communicates.
- Booking through FromChats is free of charge for the end client.
- Appointments can be cancelled or changed from the chat or from “My bookings”, within the limits the business allows.
- The client undertakes to provide truthful information, not to book appointments they do not intend to attend and not to use the chat for purposes other than booking and organizing their appointments.
- If the client sends documents, images or other data through the chat, they do so of their own accord and warrant that they are entitled to share them. They must not send health, financial or third-party data that is not needed for the appointment.
7. Health businesses
Before booking with a health business (psychology and similar activities), the end client gives explicit consent to the processing of their health data, both on the web and through the chat. That consent is recorded with its date and the version of the text accepted. The assistant does not ask the reason for the consultation.
Where the patient is a minor, the business is responsible for obtaining and keeping the consent of their father, mother or guardian, and for complying with the rules specific to its profession.
The same applies at paperwork agencies to identity documents and the documents for the procedure, because the image of an identity document is sensitive data (Law 81, art. 13; Executive Decree 285, art. 18): before booking, on the web or through the chat, the client gives explicit consent, which is recorded in the same way.
8. Prohibited activities
Using the platform for the following is expressly prohibited:
- Offering unlawful, counterfeit or stolen goods or services.
- Controlled substances, weapons, ammunition or explosives.
- Sexual services, sexually explicit material or content involving minors.
- Gambling and betting not authorized by the competent authority.
- Pyramid schemes, financial multi-level marketing or promises of guaranteed returns.
- Crypto-assets, currency exchanges or unauthorized financial services.
- Money laundering, terrorist financing or any transaction involving funds of unlawful origin.
- Sending unsolicited bulk messages or impersonation.
- Breaching, probing or overloading the infrastructure of the platform or its providers.
A breach of this clause entitles FromChats to suspend or cancel the account immediately and report the facts to the competent authorities.
9. Subscription, trial and payment
- The affiliated business pays a subscription for the use of the platform, on a monthly or annual plan. Current prices are published on the pricing page. The published price is the total payable and includes any applicable ITBMS, which is itemized on the receipt. Each team member beyond those included in the plan is added to the fee.
- Example: USD 14.99 per month, ITBMS included (USD 14.01 base + USD 0.98 ITBMS).
- The first 30 days are a trial, free of charge and with no card required.
- We do not store your card and there are no automatic charges. About 3 days before the trial and each period end, we issue a payment link that is sent by email and is available in the panel. Payment is made by credit or debit card on the dLocal Go page.
- After the due date —including at the end of the trial— there is a 3-day grace period. If payment has not been made by the end of that period, the assistant stops serving the business's clients, the business is removed from the directory and its page stops accepting bookings. The panel, the appointments already made and the data are kept.
- Once payment is made, the service is reactivated. If the grace period had already expired, the new period starts on the day of payment.
- Founder price. The first 100 businesses to register pay USD 4.99 per month, ITBMS included. That price is kept for as long as that business's subscription remains active, even if it cancels and reactivates it before the paid period ends. If the cancellation takes effect, the price is lost: if the business comes back, it joins at the list price in force at that time.
- Changes to the list price are notified by email 30 days in advance and do not affect the period already paid for.
10. Fair use of the assistant
Plans do not limit the number of conversations. To prevent abuse (loops, automated messaging, uses unrelated to bookings) there is a technical limit of 1000 conversations per month per business. If it is exceeded, the assistant stops replying until the following month. The business can write to us to have it raised.
11. Cancellation and refunds
- The business can cancel from the panel whenever it wishes, with no penalty. It keeps the service until the end of the paid period and is not charged again. There is no partial refund for unused time.
- Within 7 calendar days of a charge, the business may request a full refund of that charge, without giving reasons. FromChats grants this right voluntarily, in addition to any rights the law gives you.
- Deleting a business cancels its subscription immediately.
Full details are set out in the Refunds and Cancellations Policy, which forms part of these Terms.
12. Service availability
We aim to keep the platform available continuously, but we do not guarantee uninterrupted availability. We may carry out maintenance, update or improvement tasks that involve temporary interruptions, giving notice in advance where reasonably possible.
The service depends on third-party platforms (including Meta's WhatsApp and Instagram, Telegram and artificial intelligence providers). FromChats is not liable for changes, restrictions or suspensions imposed by those third parties, within the limits of clause 13.
13. Limitation of liability
- FromChats is not liable for the quality, suitability, legality or delivery of the services offered by affiliated businesses, nor for any charges they make to their clients.
- The assistant can make mistakes. The business is responsible for reviewing the information it publishes and the appointments it receives.
- FromChats is not liable for damages arising from misuse of the account by the holder or by third parties to whom the holder has provided their credentials.
- Except in cases of willful misconduct or gross negligence, FromChats's total liability to an affiliated business is limited to the fees that business paid it during the three months preceding the event giving rise to the claim.
- That limit does not apply to bodily injury or where the law prohibits it. In particular, if the business contracts as a consumer under Law 45 of 2007, it keeps the rights that law grants it, which cannot be limited by contract.
- Nothing in this clause limits the rights that consumer-protection legislation grants to the end client.
14. Intellectual property
The software, design, trademarks, logos and other elements of the platform are owned by FromChats or its licensors. Affiliation grants the business a limited, non-exclusive, revocable and non-transferable license of use, limited to the purpose of the service.
Content uploaded to the platform by the affiliated business remains its property. The business grants us a limited license to host, translate and display it to the extent necessary to provide the service.
15. Data protection
The processing of personal data is governed by our Privacy Policy and by Law 81 of 26 March 2019 of the Republic of Panama. With respect to the data of account holders, businesses and ambassadors, the data controller is FromChats.
Images and PDF files sent through the chat are stored in the business's conversation, where it can view them; voice notes are converted to text and the audio is not kept.
15.1 Data processing on behalf of the business
With respect to its clients' personal data, the affiliated business is the data controller and FromChats acts as custodian of the database (processor) on the business's behalf. By accepting these Terms, the business entrusts that processing to FromChats, and FromChats will:
- process the data only to provide the service and in accordance with the business's documented instructions (these Terms and the settings it makes on the platform);
- apply the security measures described in the Privacy Policy;
- keep the data confidential and require the same of anyone who accesses it;
- inform the business immediately of any security breach affecting its data and assist it in notifying ANTAI and the affected persons within 72 hours;
- not transfer the data to third parties except to the sub-processors listed in the Privacy Policy, which the business authorizes generally. FromChats will give advance notice of any additions or replacements so that the business can object, will impose equivalent obligations on them and will be answerable for their compliance;
- handle, on the business's behalf, the requests for access, rectification, erasure, objection and portability it receives at soporte@fromchats.com within the legal time limits, and cooperate on those the business receives;
- make available to the business the information needed to demonstrate compliance;
- when the relationship ends, return or delete the data, except for data a law requires to be kept.
The business warrants that it has a legal basis for processing that data and entering it into the platform and, for health services and minors, the required authorizations.
15.2 International transfers
The business acknowledges and authorizes that providing the service involves transferring data to the providers located outside Panama listed in the Privacy Policy. FromChats undertakes to use, where the provider offers them, contractual data-protection clauses consistent with Law 81 of 2019.
16. Term and termination
- The relationship is of indefinite duration and has no minimum commitment.
- The affiliated business may cancel at any time from the panel.
- FromChats may suspend or cancel an account for breach of these Terms, upon prior notice, except in cases of fraud, unlawful activity or an authority's request, in which case suspension may be immediate.
- After cancellation, we keep records of subscription charges for the legally required periods.
17. Ambassador Program
Anyone taking part in the Ambassador Program is also bound by its own terms.
18. Amendments
FromChats may amend these Terms and its prices. Every change, other than the correction of typos, is notified to the registered email and published on this page at least 30 days before it takes effect. Price changes do not affect the period already paid for, nor the founder price while it is kept (clause 9). When the version of the Terms changes, the panel will ask you to accept the new text. If you do not agree, you may cancel before that date, at no cost and with no penalty.
19. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Panama. For any dispute, the parties submit to the competent courts of the Republic of Panama. This does not prevent anyone who qualifies as a consumer —the end client and, where applicable, the business— from going to Panama's Consumer Protection and Competition Authority (ACODECO) or to the courts the law grants them.
The Spanish version of these Terms is the binding one. Translations are provided as a courtesy; in case of discrepancy, the Spanish text prevails.
20. Complaints and contact
Complaints about the platform or about a charge are sent to the email below, from the account's email address. We acknowledge receipt within 48 business hours. Anyone who qualifies as a consumer may also file a complaint with ACODECO within five years of entering into the contract.
